Terms of Use
1. About these terms
These terms apply to the FamBrief apps for iPhone and Android and to this website. FamBrief is provided by XNest LLC (“we”, “us”). By downloading or using FamBrief, you agree to these terms. Our Privacy Policy explains how information is handled.
2. What FamBrief does
FamBrief turns the messages you add, such as a school notice, a team message or appointment details, into plans, and shows what your family needs to be ready for. It helps you prepare. It isn’t a calendar service, an emergency or safety service, or a way to share plans with other people.
3. Who can use FamBrief
FamBrief is for adults, such as parents, caregivers and other adults who organize a household. You must be 18 or older, or the age of majority where you live, to use it. FamBrief isn’t meant to be used by children, although you may add plans that are for them.
4. AI suggestions and your review
FamBrief uses AI to suggest dates, times, people, places and preparation items from the messages you add, and to suggest changes to plans you already saved. Suggestions can be wrong, incomplete or out of date, and FamBrief can misread a message. That’s why nothing is saved or changed until you check it and confirm.
You remain responsible for your family’s plans and decisions. Check important details against the original message, and don’t rely on FamBrief as the only record of something important.
5. What FamBrief isn’t for
- Emergencies and safety: don’t use FamBrief for anything where a missed or late detail could put someone’s health or safety at risk.
- Advice: FamBrief doesn’t give medical, legal, financial or other professional advice.
- Sensitive records: FamBrief is for everyday family logistics. It isn’t meant for medical records, diagnoses or treatment details, legal case files, financial records or other highly sensitive records. Ordinary details such as an appointment’s time, place and what to bring are fine.
6. Your messages
You choose what to add, and you should only add messages and files you have the right to use this way. You keep all your rights in what you add. You allow us and our service providers to process it only to provide FamBrief to you, as described in the Privacy Policy, and for no other purpose.
7. Reminders
Evening reminders are a convenience. They depend on your phone’s settings, notification permissions and battery management, and they may be delayed or not delivered. Don’t rely on them for anything time-critical.
8. Your plans stay on your phone
FamBrief has no account, sync or cloud backup of its own, and it’s designed to keep its data out of phone backups. Your plans are stored only on your phone, so deleting the app, resetting the phone or losing it deletes them, and they won’t move to a new phone. We can’t recover them for you.
9. Free, Pro and subscriptions
Free includes up to 5 AI imports every 30 days and one family member by name, plus plans for everyone. FamBrief Pro is an optional subscription, monthly or yearly, with up to 100 AI imports every 30 days and everyone in your family by name. The Support page explains what counts as an import. We may change what Free and Pro include; a change to Pro won’t apply to a period you’ve already paid for.
You’ll see the price and billing period before you buy. Pro is sold through the App Store or Google Play, which charge your store account. Subscriptions renew automatically at the end of each period until you cancel. To avoid being charged for the next period, cancel at least 24 hours before the current one ends. You can manage or cancel your subscription in your App Store or Google Play account settings; deleting the app doesn’t cancel it. After reinstalling or moving to a new phone, use Restore purchases with the same Apple or Google account to get Pro back.
Refunds are handled by Apple or Google under their policies. We can’t issue refunds for purchases made through their stores. If a subscription price changes, Apple or Google will tell you in advance as their rules require.
10. App Store and Google Play
If you downloaded FamBrief from Apple’s App Store, your license to use the app is also governed by Apple’s Licensed Application End User License Agreement (the “Standard EULA”). These terms add to it; if they conflict about your license to use the app, the Standard EULA applies. Apple isn’t responsible for FamBrief or its content, and has no obligation to provide support for it.
If you downloaded FamBrief from Google Play, Google Play’s terms of service and policies also apply to your download and purchases.
11. Acceptable use
Please don’t:
- use FamBrief to break the law or anyone’s rights;
- add content you don’t have the right to use, or content meant to harm or harass someone;
- try to get around import limits, overload the service or send automated requests;
- interfere with FamBrief’s security or try to access its systems or other people’s information;
- copy, modify, reverse engineer or resell the app, except where the law allows it.
12. FamBrief’s name, mark and app
FamBrief, the FamBrief name and mark, the app and this website belong to XNest LLC. We give you a personal, non-exclusive, non-transferable right to use the app for your own household, under these terms and, where it applies, the Standard EULA. The app includes open-source components that are licensed under their own terms.
13. Other services
FamBrief relies on other services, such as the app stores, our AI provider and our subscription provider, as described in the Privacy Policy. Links to other websites are provided for convenience, and we aren’t responsible for their content.
14. Availability and changes
We work to keep FamBrief available, but it may be interrupted, and it may change. Adding a message needs an internet connection; saved plans and reminders work on your phone without one. We may change or stop features. We may update these terms by posting the new version on this page with a new date at the top. If a change is significant, we’ll also say so in the app or on this website before it takes effect. Continuing to use FamBrief after that means you accept the updated terms.
15. Stopping using FamBrief
You can stop using FamBrief at any time by deleting the app. Deleting the app doesn’t cancel a subscription, so cancel Pro with Apple or Google. Because there are no accounts, we may limit or block the use of FamBrief’s online features by an installation that breaks these terms or harms FamBrief or other people; plans already on your phone stay there.
16. No warranties
To the extent the law allows, FamBrief is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including that it will be accurate, uninterrupted or error-free, or fit for a particular purpose. Some places don’t allow these exclusions, so some may not apply to you, and nothing in these terms limits rights you have under the law that can’t be waived.
17. Limits on liability and indemnity
To the maximum extent the law allows:
- XNest LLC isn’t liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, profits or goodwill, arising from or related to FamBrief or these terms.
- XNest LLC’s total liability for all claims arising from or related to FamBrief or these terms is limited to the greater of (a) the fees you actually paid to us for FamBrief, including through the App Store or Google Play, during the 12 months immediately before the event giving rise to the claim, or (b) US$100.
These limits don’t apply to liability that can’t be limited or excluded under the law that applies to you, and they don’t affect consumer rights that the law says can’t be waived.
You agree to indemnify XNest LLC against third-party claims, and the reasonable losses and costs, including reasonable legal fees, that result from them, but only to the extent they arise from (a) your unlawful use of FamBrief, (b) your material breach of these terms, or (c) content you add without having the rights needed to use it this way. This doesn’t cover claims arising from ordinary use of FamBrief as these terms allow, from our own negligence or other fault, from errors in FamBrief’s AI suggestions, or from anything outside your control.
18. Governing law and disputes
If you have a problem with FamBrief, please email us first at support@fambrief.app so we can try to resolve it.
These terms, and any dispute arising from them or from your use of FamBrief, are governed by the laws of the State of Delaware, United States, without regard to its conflict-of-law principles. Disputes will be heard in the state or federal courts located in Delaware, and you and we agree to their jurisdiction.
This doesn’t take away the protection of consumer laws that apply to you and can’t be waived, including any mandatory right to bring a claim in the courts where you live. If you downloaded FamBrief from the App Store, the Standard EULA’s own governing-law terms apply to the license it grants (section 10); these terms govern everything else.
